MINUTES OF THE PUBLIC MEETING OF FEBRUARY 22ND, 2005
HANSON TOWN HALL, LIBERTY ST., HANSON, MA

Called to Order:  7:30 PM under the M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5.  by Philip R. Lindquist, Chairman in Meeting Room A in the Town Hall.

Public Hearings
7:45 PM   Request for an Amendment to an Order of Conditions for construction of an addition to an existing house within 100-feet of a Bordering Vegetated Wetland at 52 Beechwood Road, Assessor’s Map 115, Lot 124 for Paula Todd, applicant.  (DEP #175-377)  (New Hearing)

Craig Nicholson read the public hearing notice and the abutter’s were verified.  Bob Durgin of Custom Designs in Pembroke presented plans.    Ms. Delaney confirmed that the previous wetland line was still valid.  The original plan accompanying the Order of Conditions for a septic repair showed a proposed addition 30-feet from the wetland line.  The addition was never constructed.   Mr. Durgin presented a new plan showing the proposed addition on the other side of the house more than 50-feet from the wetland.  Phil Lindquist suggested that if the Order of Conditions was amended it shall refer to the correct plans.   Also, haybales shall be placed along the 50-foot buffer zone.  The abutter’s list was read.  Those present were:

Gerald Fleming, 68 Beechwood Rd.:  Mr. Fleming had concerns of debris being stockpiled in the wetland.  Mr. Delaney suggested that a condition is added to the Order of Conditions that no grass clippings are allowed within 100 feet of the wetland area.

8:00 PM  Request for Determination of Applicability to determine whether the boundaries of resource areas depicted on the plan are accurately delineated for rights-of-way management (vegetation Control) along the Massachusetts Bay Commuter Railroad for TEC Associates, 46 Sawyer Street, South Portland, ME  04106

Craig Nicholson read the public hearing notice.  Phil Lindquist read the letter from TEC Associates.  Ms. Delaney will call TEC Associates and ask for a more comprehensive plan.

8:15 PM  After-the-Fact Notice of Intent to determine if an un-permitted fence constructed in the Riverfront area is allowed to remain in place at 7 Joshua Lane, Map 37, Lot 1-1N for Timothy Pratt, owner.  

Craig read the public hearing notice.  The abutters had not been notified.  The Pratt’s were advised to obtain a certified list from the Assessor’s Office and notify their abutters before the next hearing.

8:30 PM  Continued Notice of Intent for the construction of a new, single-family house, subsurface disposal system, utilities, site grading and landscaping of disturbed areas within the 100-foot buffer zone of a bordering vegetated wetland at 484 Pleasant St., Assessor’s Map 16, Lots 15B & 15B-1 for Masako Pina represented by Land Planning, Inc., 1115 Main St., Hanson (DEP #175-0459)   

Ms. Delaney was able to make a site inspection because the snow cover had melted.  It was her opinion that the isolated wetland line was not completely accurate, however, it didn’t have an impact on the project.  Also, there were several 55-gallon drums in the wetland off site.  Mr. Lindquist suggested a revised drawing be submitted showing a change in the flagging per Ms. Delaney’s inspection.  Flags 1,2,5,7 & 9 were deemed accurate.

Discussions

Comprehensive Permit for Dunham Farms –  the previous RDA filing for which a Determination of Applicability was made on April 10, 2003 was reviewed and the current building permit was signed by Janine Delaney.  A Mr. John Buckley and a Mr. Dennis Sargeant, abutters to the property, voiced concerns but were advised by the Commission that the applicant had already followed procedure and had been issued a permit.

Request for Certificate of Compliance for Valley Forge Road (Local Filing #99-5) – an adequate plan was not submitted. Ms. Delaney will write a letter to owners.

Site Visit for Superseding Order of Conditions for Deerhill Extension on March 9, 2005 at 9:30 AM (DEP #175-0452) Phil Lindquist read the letter from DEP.  Someone will try to be there.

Finance Committee Budget Meeting with Conservation Commission to discuss budgetary issues on Tuesday, March 15th at 8 PM – Phil Lindquist will be the delegate.

2005 Yearly Operational Plan (YOP) for Vegetation Mgmt. thru rights-of-way by Massachusetts Electric Company –   reviewed

Enforcement Order for Lot 5, Ransom Road – Ms. Delaney had inspected the property.  A DEP sign was not posted, the haybales were decomposed and the well was not installed in the approved place.
